1. Agreement and site use

These Terms & Conditions (the “Terms”) govern your access to and use of this website and its storefront services. “We,” “us,” and “our” mean Darrin's Garage. By visiting the site, creating an account, placing an order, or submitting content, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the site.

We may update these Terms when our services, technology, or legal obligations change. The revised Terms are effective when posted with a new “Last updated” date. We may change, suspend, restrict, or discontinue any part of the site where reasonably necessary.

2. Products, orders, and payment

Product descriptions, prices, availability, images, specifications, and fitment information are provided in good faith. We may correct errors, update information, limit quantities, reject or cancel an order, or contact you for additional information. An order confirmation acknowledges your request; acceptance occurs when payment is completed and we begin processing the order.

Payments are processed by PayPal. We do not receive or store your full card number, bank account number, or PayPal password. PayPal’s services are governed by its own terms and privacy statement. You authorize us and PayPal to process the information needed to complete, verify, refund, or support your transaction.

Unless otherwise stated, prices are in U.S. dollars. Applicable shipping charges and taxes are shown during checkout. Shipping estimates are not guarantees and may be affected by carriers, inventory, weather, or events outside our reasonable control.

3. Fitment and installation

Vehicle fitment tools and recommendations are aids, not a substitute for confirming the exact application. Before ordering or installing a part, verify the year, make, model, engine, trim, dimensions, specifications, and manufacturer instructions. Installation should be performed by a qualified person using appropriate tools and safety procedures. Contact us before ordering when you are unsure.

4. Accounts

You are responsible for activity under your account and for keeping access to your Google account and devices secure. Provide accurate information and promptly update it when it changes. You may not use another person’s account, impersonate anyone, or create an account for unlawful or fraudulent activity. We may refuse service, cancel orders, or suspend access when reasonably necessary to protect customers, the site, or our business.

5. Ownership and acceptable content

Except for third-party materials, site design, text, graphics, software, photographs, logos, and other content are owned by or licensed to Darrin's Garage and are protected by applicable intellectual-property laws. You may use the site for personal shopping and informational purposes. You may not copy, modify, publish, frame, scrape, resell, or distribute site content without written permission, except as permitted by law.

Product names, manufacturer marks, and other third-party content belong to their respective owners. Their appearance does not transfer any rights to you.

6. Reviews and other user content

If you submit a rating, review, message, or other content, you retain your ownership rights and grant us a nonexclusive, worldwide, royalty-free license to host, reproduce, display, format, and use that content to operate and promote the site. You represent that your submission is truthful, is based on your experience, does not infringe another person’s rights, and is not unlawful, abusive, misleading, obscene, or promotional spam.

We may moderate or remove user content, but we are not obligated to publish or monitor every submission. Do not include payment credentials, private contact information, or another person’s personal information in a review.

7. Prohibited conduct

You may not:

• Introduce malware, harmful code, or disruptive traffic;
• Probe, scan, bypass, or interfere with security, authentication, rate limits, or access controls;
• Use bots, scrapers, or automated methods to obtain content or data not intentionally made available, except ordinary search-engine indexing that follows our published directives;
• Access another user’s account or personal information;
• Submit false orders, fraudulent payment activity, unlawful content, or unauthorized advertising;
• Infringe intellectual-property, privacy, publicity, or other rights; or
• Use the site in violation of applicable law or in a way that harms other users or our operations.

8. Third-party services and links

The site may use or link to services operated by others, including PayPal, Google, Cloudflare, manufacturers, suppliers, and shipping carriers. We do not control their independent services, content, availability, terms, or privacy practices. Your dealings with a third party are between you and that party, subject to its terms.

9. Disclaimers and limitation of liability

To the fullest extent permitted by law, the site and its information are provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement as to the site itself. Product warranties, if any, are provided under the applicable manufacturer or written sales terms.

To the fullest extent permitted by law, Darrin's Garage and its owners, employees, agents, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost data, or loss of use arising from the site or these Terms. Nothing in these Terms excludes liability that cannot lawfully be excluded or limits rights you have under applicable consumer-protection law.

10. Security, enforcement, and termination

We may investigate suspected violations; preserve relevant communications and records; restrict or terminate access; cancel affected orders; and cooperate with payment providers, rights holders, or lawful authorities. We may disclose information when reasonably necessary to comply with law, enforce these Terms, prevent fraud, or protect the rights, property, or safety of customers, the public, or our business.

Provisions that by their nature should survive termination—including ownership, licenses, disclaimers, limitations, and dispute provisions—will continue to apply.

11. Copyright concerns

If you believe material on the site infringes your copyright, send us a notice identifying the protected work, the challenged material and its location, your contact information, a good-faith statement that the use is unauthorized, a statement under penalty of perjury that the notice is accurate and you are authorized to act, and your physical or electronic signature.

12. Governing law and general terms

These Terms are governed by the laws of the State of Alabama, without regard to conflict-of-law rules. To the extent a dispute may be brought in court, the parties consent to the state or federal courts serving Mobile County, Alabama, except where applicable law requires otherwise. If any provision is unenforceable, the remainder remains effective. Our failure to enforce a provision is not a waiver. These Terms and the Privacy Policy form the agreement regarding use of the site, except for any separate written terms that apply to a specific purchase or service.
